Session description: The use of GenAI in litigation is growing rapidly, which has raised complex ethical issues for attorneys. This panel will discuss what counsel must do to comply with ethical rules when selecting and using GenAI tools, especially rules governing protection of client information, communication with clients, competent representation, supervision and independent professional judgment. The discussion will feature a particular focus on ABA Model Rule 5.3(b) and ABA Formal Opinion 512 and how they are interpreted in the legal profession.
